This service is provided by Lemon Interactive Ltd. ("We" or "Lemon Interactive Ltd") to you ("you" or "user"), subject to the terms of this agreement ("Agreement"), and the rules that may be published from time to time by Lemon Interactive Ltd. Lemon Interactive Ltd currently offers services to users who agree to abide by (i) the terms and conditions of this Agreement; (ii) the privacy policy, and (ii) any guidelines posted on the Lemon Interactive Ltd network of sites. Lemon Interactive Ltd reserves the right to change the nature of this relationship at any time without notice to you. In addition, when using particular services of Lemon Interactive Ltd, you shall be subject to any posted guidelines or rules applicable to such services, which may be posted by Lemon Interactive Ltd from time to time. All such guidelines or rules are hereby incorporated by reference into this Agreement. Users who violate the terms of this Agreement will have their Lemon Interactive Ltd account ("Account") cancelled and they may permanently be banned from using Lemon Interactive Ltd. ENTERING a page of the Lemon Interactive Ltd site WILL CONSTITUTE ACCEPTANCE OF THE TERMS AND CONDITIONS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO ABIDE BY THESE TERMS, PLEASE DO NOT ENTER ANY SITE OF THE Lemon Interactive Ltd SITE.

1. Description of Service
Lemon Interactive Ltd currently provides users with access to promotions and offers via SMS and the Website, including, personalized content and branded programming through its network (the "Service"). Please note that your profile information will not be publicly available to other users. For the SMS Service that is provided directly to your mobile phone, you will not be charged. In order to facilitate the service we will be required to share mobile phone numbers with our partners this is the only part of the profile that they will see and therefore provides anonymity to the user. Unless explicitly stated otherwise, any new features that augments or enhances the current Service, including but not limited to the release of new Lemon Interactive Ltd properties, shall be subject to this Agreement. You understand and agree that the Service is provided "AS-IS" and that Lemon Interactive Ltd assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or personalization settings. In order to use the Service, you must obtain access to the World Wide Web, either directly or through devices that access web-based content and data, and pay any service fees associated with such access. In addition, you must provide all equipment necessary to make such connection to the World Wide Web, including a computer and modem or other access device. Please be aware that Lemon Interactive Ltd has created certain areas on the Service that access adult or mature content. You must be at least 18 years of age to access such services.

YOU UNDERSTAND THAT Lemon Interactive Ltd MAY MODIFY SERVICES AT ANY TIME AND THAT Lemon Interactive Ltd SPECIFICALLY RESERVES THE RIGHT FROM TIME TO TIME TO ALTER THE NUMBER OF MESSAGES AND OTHER FREE SERVICES OR ELIMINATE ANY OR ALL FREE OFFERINGS ENTIRELY AT ITS SOLE DISCRETION, WITH OR WITHOUT NOTIFICATION. PLEASE CHECK BACK OFTEN TO UNDERSTAND THE LATEST AND CURRENT OFFERINGS.

2. Your Registration Obligations

Accordingly, as a legal guardian, it is your responsibility to determine whether any of the Services and/or Content (as defined in Section 4 below) is appropriate for your child. You agree to grant Lemon Interactive Ltd a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicenseable (through multiple tiers), right to exercise the copyright and publicity rights you have to your Registration Data and any information you provide to Lemon Interactive Ltd or other partners within the Service ("Your Information"), in any media now known or not currently known. Lemon Interactive Ltd will only use the Registration Data and Your Information in accordance with Lemon Interactive Ltd Privacy Policy. You agree that Lemon Interactive Ltd adds the tag line "Get Something for Nothing - www.lemonmobile.com!" at the end of the message if the message has enough space for this tag line.

3. Account, Password, and Security
You are responsible for maintaining the confidentiality of the password for your Account, and are fully responsible for all activities that occur under your password or Account. You agree to (a) immediately notify Lemon Interactive Ltd of any unauthorized use of your password or Account or any other breach of security, and (b) ensure that you exit from your Account at the end of each visit. Lemon Interactive Ltd cannot and will not be liable for any loss or damage arising from your failure to comply with this Section 3.

4. User Conduct
You understand that all information, offers, promotions via text or email ("Content") privately transmitted, are the sole responsibility of the company from which such Content originated. The service partner of Lemon Interactive Ltd controls the Content posted or transmitted in any way via the Service and, as such, does guarantee the accuracy, integrity, or quality of such Content. You understand that by using this Service you may be exposed to Content that is offensive, indecent, or objectionable. Under no circumstances will Lemon Interactive Ltd be liable in any way for any Content, including but not limited to, any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the user of any Content posted, emailed, sent via SMS via the Service. 3. Provide any content which may be harmful or detrimental to Lemon Interactive Ltd or its business associates, or which violates any restriction or policy established by Lemon Interactive Ltd or its business associates.

You agree that you must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content. In this regard, you acknowledge that you may not rely on any Content created by Lemon Interactive Ltd or transmitted through the Service, or submitted to Lemon Interactive Ltd.

5. Indemnity
You agree to indemnify and hold Lemon Interactive Ltd, and its subsidiaries, affiliates, officers, agents, customers or other partners, and employees, harmless from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of Content you receive by transmission via email or SMS, post to the site, your use of the Service, your connection to the Service, your violation of this Agreement, or your violation of any rights of another.

6. Legal Notices regarding Third Party trade offers
Lemon Interactive Ltd is pleased to facilitate the use of its Web Site and its systems to Third Party companies ("Partners") wishing to advertise on Lemon Interactive.com. However, Lemon Interactive Ltd does not actively control the validity of such offers. Please read the following information.

No Warranties relating to Information: Lemon Interactive Ltd makes no warranties or representations of any kind concerning the accuracy, suitability or safety of the information contained on the Lemon Interactive Ltd Web Site related to Partner Content and the text messages that are sent to those persons requesting, via their profile, Partner Content. You agree that any termination of your access to the Service under any provision of this Agreement may be effected without prior notice, and acknowledge and agree that Lemon Interactive Ltd may immediately deactivate or delete your Account and all related information and/or bar any further access to the Service. Further, you agree that Lemon Interactive Ltd shall not be liable to you or any third-party for any termination of your access to the Service.

10. Dealings with Advertisers and Users
Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through the Service, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser. You agree that Lemon Interactive Ltd shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the Service.

You acknowledge and agree that the Service and any necessary software used in connection with the Service ("Software") contain proprietary and confidential information that is protected by applicable intellectual property and other laws. You further acknowledge and agree that Content contained in sponsor advertisements or information presented to you through the Service or advertisers is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. "Lemon Interactive Ltd Trademarks" means all names, marks, brands, logos, designs, trade dress and other designations that are used by Lemon Interactive Ltd in connection with its website, products and services, including, without limitation, Lemon Interactive Ltd and "Get Something for Nothing". All other trademark and service marks appearing on Lemon Interactive Ltd ’s web site which do not belong to Lemon Interactive Ltd are the property of their respective owners. Except as expressly authorised by Lemon Interactive Ltd or advertisers, you agree not to copy, modify, rent, lease, loan, sell, distribute or create derivative works based on the Service or the Software, in whole or in part.

13. Disclaimer of Warranties
YOU EXPRESSLY UNDERSTAND AND AGREE THAT: (a) YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. (b) Lemon Interactive Ltd MAKES NO WARRANTY THAT (i) THE SERVICE WILL MEET YOUR REQUIREMENTS; (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE; (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS, AND (V) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED. 14. Limitation of Liability
YOU EXPRESSLY UNDERSTAND AND AGREE THAT Lemon Interactive Ltd SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF Lemon Interactive Ltd HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE SERVICE; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (v) ANY OTHER MATTER RELATING TO THE SERVICE. Lemon Interactive Ltd ’s LIABILITY, AND THE LIABILITY OF OUR SUPPLIERS, TO YOU OR ANY THIRD PARTIES IN ANY CIRCUMSTANCES IS LIMITED TO £0.01.

15. Notice
Notices to you may be made via email, SMS (short message service), or the Service may also provide notices of changes to this Agreement or other matters by posting notices or links to notices generally on the Service.

16. General Information
This Agreement constitutes the entire agreement between you and Lemon Interactive Ltd and governs your use of the Service, superceding any prior agreements between you and Lemon Interactive Ltd. You also may be subject to additional terms and conditions that may apply when you use affiliate services, third-party content or third-party software. This Agreement and the relationship between you and Lemon Interactive Ltd shall be governed by the laws of the UK. The failure of Lemon Interactive Ltd to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of this Agreement remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or this Agreement must be filed within one (1) year after such claim or cause of action arose or be forever barred. The section titles in this Agreement are for convenience only and have no legal or contractual effect.
